On July 27, the first-instance verdict was delivered in the case in which former South Korean President Yoon Suk-yeol was accused of violating the Public Office Election Act. Yoon Suk-yeol was sentenced to one year and six months in prison, suspended for three years. According to South Korean law, if Yin Xiyue is sentenced to fixed-term imprisonment in the final trial of the case, his president's election will be invalid.
South Korea's Seoul Central District Court made a first-instance judgment on the case on the same day. The court found that during his tenure as the presidential candidate of the National Forces Party, Yin Xiyue claimed that he had "not introduced a lawyer to the former Longshan Tax Director" and other remarks were false statements, and related remarks involving meetings with vulgar people also violated the Public Election Law..
According to South Korea's "Public Election Law", those who violate the law and are sentenced to fixed-term imprisonment or a fine of 1 million won (about 4610 yuan) or more in the final instance shall be invalid and the election expenses previously compensated by the Central Electoral Management Commission shall be returned. Among them, for candidates recommended by political parties in the presidential election, the compensation for their campaign expenses shall be returned by the political party that recommended the candidate.
According to South Korean media reports, after Yin Xiyue won the 2022 presidential election, the National Power Party received 39.7 billion won (about 0.183 billion yuan) in compensation for campaign expenses. If Yin Xiyue is found to be invalid in the final trial of this case, the funds will be returned in full.
